We filed a merits brief on May 19, 2011: the Petitioner’s Brief in Douglas v. Independent Living Ctr. of So. Cal., Inc., Cal. Pharmacists Ass’n., and Santa Rosa Memorial Hosp., Nos. 09-958, 09-1158 and 10-283. The petition raises the question of whether the Supremacy Clause creates a private cause of action to enforce a provision of the Medicaid Act, 42 U.S.C. 1396a(a)(30)(A), that does not confer any individual rights.
