About Shon R. Hopwood

Shon R Hopwood’s unusual legal journey began not at law school, but federal prison, where he learned to write briefs for other prisoners. Two petitions for certiorari he prepared were later granted review by the United States Supreme Court, and the story of his legal success was the subject of articles in the New York Times, the Saturday Evening Post, and Above the Law. His work has been published in the Harvard Civil Rights-Civil Liberties and Fordham Law Reviews. He is a consultant at Cockle Law Brief Printing Company, and a student and Gates Public Service Scholar at the University of Washington School of Law. In August of 2012, Crown/Random House will publish his memoir entitled “Law Man: My Story of Robbing Banks, Winning Supreme Cases and Finding Redemption.” Through a decade of letters, Shon convinced his kind and beautiful wife, Ann Marie, to marry him. He has one cute but incredibly ornery son, Mark Raymond, and a precious and beautiful baby girl, Grace. Shon enjoys liberty, the writing of the Apostle Paul, Amy Hempel, and Raymond Carver, the music of Radiohead, and watching the Nebraska Cornhuskers football team. Follow me at: @shonhopwood

Attaching a GPS Device to a Car Is a Fourth Amendment Search

2012-01-23T16:08:13-06:00January 23rd, 2012|Tags: , , , |

In a big loss for the federal government, the Supreme Court held today that when the government attaches a GPS device to a vehicle to monitor the vehicle's movement, the government conducts a Fourth Amendment search. Justice Scalia wrote the opinion for the Court in United States v. Jones, No. 10-1259, backed by the Chief Justice, [...]

Attorney Abandonment Matters at the Supreme Court

2019-03-18T18:47:49-05:00January 19th, 2012|Tags: , , , |

Yesterday, Justice Ginsburg announced the decision in Maples v. Thomas. For the second time in the last two years, the Supreme Court said that it matters when an attorney abandons their client. It Matters. For prisoners this is good news for those pursuing postconviction relief. The Court has long held that a criminal defendant has no right to [...]

Conor Friedersdorf Rebuts Santorum’s Arguments Against Same-Sex Marriage

2012-01-18T05:07:55-06:00January 18th, 2012|Tags: , , , |

Same-sex marriage promises to be an enormously divisive issue in this election year. No current candidate stands for gay marriage: President Obama advocates civil unions and Congressman Ron Paul says that the issue should be left to the states. Yet, several candidates are vehemently opposed to same-sex marriage. One of them is Rick Santorum. Now, [...]

Balancing Away Freedoms and the Response from Religious Groups to the Supreme Court’s Decision in Hosanna-Tabor

2019-03-18T18:47:49-05:00January 14th, 2012|Tags: , , |

This week, in what Adam Liptak at the New York Times suggested was “most significant religious liberty decision in two decades, the Supreme Court ruled in Hosanna-Tabor Evangelical Lutheran Church v. EEOC that: The interest of society in the enforcement of employment discrimination statutes is undoubtedly important. But so too is the interest of religious groups [...]

Three Hopeful Changes for the Criminal Justice System in 2012

2019-03-18T18:47:49-05:00January 14th, 2012|Tags: , , , , , |

I am a little late on New Year's resolutions. But I thought I would shoot for three things I would like to see happen in the criminal justice system in 2012. At number three I would like to see the U.S. Supreme Court declare, loud and clear, that lawyers must be constitutionally effective at the [...]

The Allure of Civil Libertarian Ron Paul: Three Reasons Why He’s Gained a Following of Young People and Is a Grave Threat to the Political Establishment

2019-03-18T18:47:49-05:00January 3rd, 2012|Tags: , , , , , , |

Mainstream media—like CBS and the New York Times—have reported that in the days leading up to the Iowa primary, a large number of young adults have flowed into Iowa like this past summer’s floods down the Missouri river. They have arrived with one mission: aid and assist Presidential candidate Ron Paul in [...]

The Goldwater Institute’s Litigation Arm

2015-03-02T19:22:53-06:00December 26th, 2011|

Yesterday, the New York Times published an article explaining the work of the Goldwater Institute, one of the leading libertarian organizations in the country. The GI's litigation arm generally challenges any government infringement of individual liberties, including what it calls entrepreneurial freedom. What I found most interesting is that the Goldwater Institute doesn't play favorites: it [...]

Religious Freedom Versus Workplace Discrimination

2019-03-18T18:47:49-05:00December 26th, 2011|

Cases at the U.S. Supreme Court often involve a collision of competing values, such as Fourth Amendment cases where the right to privacy runs headfirst into the ability of police to acquire relevant inculpatory evidence. Cases in which important values clash are some of the most difficult for the Court to decide [...]
